The Zoning Department is responsible for the enforcement of the City of Hendersonville Zoning Ordinance including building setbacks, parking requirements, landscaping and signs as well as staffing the Zoning Board of Adjustment. CODE ENFORCEMENT:
In addition to the Zoning Ordinance the Zoning Department is responsible for the enforcement of the Flood Prevention Ordinance, Minimum Housing Ordinance and Nuisance Ordinance. These are briefly described below:
Flood Prevention Ordinance: The City of Hendersonville participates in the National Flood Insurance Program. This allows residents of the City of Hendersonville and its jurisdiction to purchase flood insurance. The Flood Prevention Ordinance regulates fill and encroachments within the flood hazard areas of the City. It is the purpose of this ordinance to promote the public health, safety and general welfare and to minimize public and private losses due to flood conditions in specific areas.
Minimum Housing Code: The City of Hendersonville has adopted the Southern Building Code Congress International "Standard Housing Code" as the minimum housing code for the City of Hendersonville. This ordinance is adopted to secure the beneficial interest and purposes thereof which are public safety, health and general welfare through structural strength, stability, sanitation, adequate light and ventilation and safety to life and property from fire and other hazards incidental to construction, alteration, repair, removal, demolition, use or occupancy of residential buildings and accessory structures.
Nuisance Ordinance: It is unlawful within the City of Hendersonville for the owner or occupant of any lot, residence, parcel of land or other building to permit to exist on any such lot, residence, building or parcel of land, any condition which is dangerous or prejudicial to the public health and which may be declared to be noxious or constitute a nuisance.
